These Terms of Service ("Terms") govern your access to and use of Moonlog ("Service"), operated by Moonlog ("Company," "we," "us," or "our"). By accessing or using Moonlog, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.

1. Acceptance of Terms

Your access to and use of Moonlog constitutes your acceptance of and agreement to be bound by all provisions of these Terms. If you are entering into this agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. Your continued use of Moonlog following the posting of any changes to these Terms constitutes your acceptance of those changes.

2. Description of Service

Moonlog is a lunar cycle tracking and astrological insight platform designed to provide users with personalized lunar phase information, astrological readings, and celestial guidance. The Service allows users to log personal observations, track lunar cycles across calendar views, receive astrological interpretations, and explore cosmic wellness recommendations aligned with lunar and planetary movements.

Moonlog is provided on an "as-is" basis through its web platform accessible at moonlog.co. The Service includes documentation, user guides, and customer support as outlined in your selected subscription tier.

3. User Accounts

3.1 Account Registration

To access certain features of Moonlog, you must create an account. During registration, you are required to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your email address and password. You agree to accept responsibility for all activities that occur under your account.

3.2 Account Eligibility

By creating an account, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into this agreement. Users under 18 may only use Moonlog with verifiable parental or guardian consent and supervision.

3.3 Account Termination

Moonlog reserves the right to suspend, disable, or terminate any account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases, though archived log entries may be retrieved upon written request for up to 90 days following termination.

3.4 Account Security

You are solely responsible for maintaining the security of your account and for all activities conducted through your account. Moonlog is not liable for any unauthorized access to your account resulting from your failure to maintain account security or from your voluntary sharing of credentials.

4. Payment Terms

4.1 Subscription Plans

Moonlog offers three subscription tiers:

  • MoonLog Lunar: $9.99 per month — Access to basic lunar cycle tracking, monthly astrological digests, and essential features
  • MoonLog Celestial: $14.99 per month — Access to all Lunar features plus personalized astrological readings, advanced lunar phase insights, and priority customer support
  • MoonLog Cosmic: $24.99 per month — Access to all Celestial features plus one-on-one astrological consultations, exclusive cosmic wellness guides, custom lunar forecasts, and dedicated account management

4.2 Billing and Charges

Your subscription renews automatically on the same calendar date each month unless cancelled. Billing occurs at the beginning of each subscription period. All charges are non-refundable except as expressly stated in Section 4.4. Moonlog reserves the right to change subscription pricing with 30 days' written notice. Price changes apply to renewals occurring after the notice period.

4.3 Payment Method

You authorize Moonlog to charge your selected payment method (credit card, debit card, or digital wallet) for all subscription fees and applicable taxes. You are responsible for ensuring your payment method remains current and valid. If payment fails, your access may be suspended until payment is successfully processed. Repeated payment failures may result in account termination.

4.4 Refunds and Cancellation

Subscriptions may be cancelled at any time through your account settings. Upon cancellation, your access continues until the end of your current billing period. No refunds are issued for the current billing period, regardless of when cancellation occurs during that period. If you cancel within 7 days of initial purchase, you may request a full refund of your first month's subscription fee by contacting support@moonlog.co.

Refund requests must be made in writing and include your account email address and subscription tier. Refund decisions are made at Moonlog's sole discretion. Approved refunds are processed within 10 business days to the original payment method.

4.5 Taxes

All prices are exclusive of applicable sales tax, value-added tax, goods and services tax, or other similar taxes or duties. You are responsible for all taxes applicable to your use of Moonlog, and Moonlog may collect such taxes on your behalf where permitted by law.

4.6 Overdue Accounts

If your account becomes overdue, Moonlog may suspend your access to the Service without further notice until payment is received. Repeated non-payment may result in permanent account termination.

5. Intellectual Property Rights

5.1 Company Intellectual Property

All content, materials, software, features, functionality, and designs of Moonlog, including but not limited to text, graphics, logos, images, astrological interpretations, lunar tracking algorithms, and user interface elements, are the exclusive property of Moonlog or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

5.2 License Grant

Subject to your compliance with these Terms, Moonlog grants you a limited, non-exclusive, non-transferable, revocable license to access and use Moonlog for your personal, non-commercial use. This license does not include the right to reproduce, distribute, publicly display, perform, or create derivative works based on any Moonlog content or materials, except as necessary for your personal use of the Service.

5.3 User-Generated Content

You may submit content to Moonlog, including log entries, notes, observations, and personal reflections ("User Content"). By submitting User Content, you grant Moonlog a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, and display such content solely for the purpose of providing and improving the Service. You represent and warrant that you own or have the right to grant these rights to any User Content you submit.

5.4 Ownership of User Content

You retain all ownership rights to your User Content. However, by submitting User Content to Moonlog, you acknowledge that Moonlog may use aggregated and anonymized versions of such content to improve the Service, conduct research, or enhance astrological interpretations and cosmic guidance features.

5.5 Restrictions

You may not:

  • Copy, modify, or create derivative works of Moonlog or its content
  • Reverse-engineer, disassemble, decompile, or attempt to derive the source code of Moonlog
  • Remove or obscure any proprietary notices, labels, or marks
  • Use Moonlog for any unlawful purpose or in violation of these Terms
  • Sell, rent, lease, transfer, assign, or sublicense access to Moonlog
  • Use automated tools, bots, scrapers, or similar mechanisms to access Moonlog without express authorization
  • Attempt to gain unauthorized access to Moonlog systems, networks, or data

6. Limitation of Liability

6.1 Disclaimer of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONLOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF MOONLOG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.

6.2 Cap on Direct Liability

EXCEPT FOR CLAIMS ARISING FROM YOUR VIOLATION OF INTELLECTUAL PROPERTY RIGHTS OR INDEMNIFICATION OBLIGATIONS, MOONLOG'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF MOONLOG SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU UNDER YOUR SUBSCRIPTION TO MOONLOG IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

6.3 Specific Limitations

Moonlog shall not be liable for:

  • Service interruptions, delays, errors, or omissions due to technical failures, system maintenance, or circumstances beyond Moonlog's reasonable control
  • Data loss, corruption, or unauthorized access resulting from causes outside Moonlog's reasonable control
  • Third-party services, integrations, or external content accessed through Moonlog
  • Your reliance on astrological readings, lunar forecasts, or cosmic guidance provided through Moonlog
  • Any personal, emotional, financial, or health-related consequences arising from your use of the Service
  • Interactions, disputes, or communications with other users of Moonlog
  • Any failure or delay in performance due to cause beyond Moonlog's reasonable control

6.4 Essential Provision

You acknowledge that the limitations of liability in this Section are essential terms of this agreement and are a basis for Moonlog's pricing and willingness to offer the Service. Without these limitations, Moonlog would not be able to provide the Service at the prices offered.

7. Disclaimer of Warranties

7.1 "As-Is" Service

MOONLOG IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. MOONLOG EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

7.2 No Guarantee of Functionality

Moonlog makes no warranty that:

  • The Service will be uninterrupted, error-free, or secure
  • Any defects or errors will be corrected
  • The Service will meet your specific requirements or expectations
  • Results obtained from the Service will be accurate, complete, or reliable
  • Astrological interpretations, lunar forecasts, or cosmic guidance will be accurate or applicable to your circumstances

7.3 Entertainment and Informational Purposes Only

Moonlog provides astrological content, lunar cycle information, and cosmic guidance strictly for entertainment and informational purposes. The Service is not intended to provide professional advice of any kind, including but not limited to medical, legal, financial, psychological, spiritual, or therapeutic advice. Moonlog makes no claims regarding the scientific validity, accuracy, or efficacy of astrological practices or cosmic wellness recommendations.

7.4 Not a Substitute for Professional Guidance

You acknowledge and agree that:

  • Astrological readings and lunar forecasts are interpretations based on astrological theory and are not scientifically validated
  • The Service should not be relied upon as a substitute for professional medical, psychological, financial, legal, or therapeutic advice
  • For matters of health, finance, law, mental health, or significant life decisions, you should consult with qualified professionals in the relevant field
  • Any wellness recommendations provided through Moonlog are suggestions only and should not replace professional medical care
  • Moonlog makes no representation regarding the healing, protective, or transformative properties of lunar cycles or astrological influences

8. Indemnification

You agree to indemnify, defend, and hold harmless Moonlog, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your violation of these Terms
  • Your use or misuse of Moonlog
  • Your User Content or your submission of content to Moonlog
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party intellectual property rights
  • Your interactions with other users
  • Any action or inaction resulting from your reliance on Moonlog content or guidance

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to these Terms or your use of Moonlog shall be brought exclusively in the state and federal courts located in San Francisco County, California, and you irrevocably consent to the jurisdiction and venue of such courts.

10. Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute through good faith negotiation. If negotiation fails, you agree to attempt mediation through a mutually selected mediator before pursuing litigation. Both parties agree to participate in mediation in good faith and to share the costs of mediation equally.

11. Changes to These Terms

Moonlog reserves the right to modify these Terms at any time. Changes become effective immediately upon posting to moonlog.co. Your continued use of Moonlog following the posting of modified Terms constitutes your acceptance of the modifications. If any modification is unacceptable to you, your only recourse is to cease using Moonlog. For material changes that negatively affect your rights, Moonlog will provide 30 days' advance notice via email to your registered account email address.

12. Termination

Moonlog may terminate or suspend your access to the Service, in whole or in part, at any time with or without notice and without liability for any reason or no reason, including but not limited to your violation of these Terms, non-payment of subscription fees, or use of the Service in a manner that Moonlog determines, in its sole discretion, is harmful or unlawful. Upon termination, your right to use Moonlog immediately ceases. Sections that are intended to survive termination, including Limitation of Liability, Intellectual Property Rights, Indemnification, and Governing Law, shall remain in effect.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with Moonlog's Privacy Policy and any other legal notices published on moonlog.co, constitute the entire agreement between you and Moonlog regarding your use of the Service and supersede all prior and contemporaneous agreements, understandings, and negotiations, whether written or oral.
